Find my pathAbout this term
The title company or buyer's attorney conducts a title search to ensure the seller has the legal right to convey the property and that no liens, judgments, or other defects exist. If defects are found, the seller has until the title deadline to cure them. If the seller cannot cure the defects by the deadline, the buyer may terminate the contract and receive earnest money back.
Pro Tip
Order the title search immediately after contract acceptance. Identify and cure any issues well before closing.
Example
A title search reveals an old mortgage lien that was supposedly paid off but not recorded; the seller must provide a release from the lender by the title deadline, or the buyer can terminate the contract.
