Definition

Timber rights are the legal permission to harvest trees. Like mineral rights, they can be separated from surface rights. Someone could own your forest while you own the surface—creating conflicts if they harvest aggressively.

About this term

Timber rights allow harvesting while surface rights remain with another owner. Separated timber rights can complicate property use and value.

Pro Tip

Verify who owns timber rights. If separated from surface rights, understand harvest conditions and whether they'll conflict with your use.

Example

A timber company holding harvesting rights to timber on property while owner retains surface rights.
