About this term

Specific performance is a powerful legal remedy that forces the breaching party to complete the transaction as agreed. If a buyer breaches without valid contingencies, a seller can seek specific performance to force the buyer to close. Similarly, if a seller breaches, a buyer can seek to force the seller to sell the property. This remedy is often preferred over monetary damages because it results in the intended transaction.

Pro Tip

Understand specific performance is possible. Don't assume you can walk away without consequences.

Example

The seller sued for specific performance, asking the court to force the buyer to close on the property.
