A lis pendens (Latin for 'litigation pending') is a notice recorded in the public record when someone files a lawsuit affecting the property. It alerts potential buyers and creditors that the property's title or ownership is being disputed in court. A lis pendens significantly complicates property sales because buyers won't purchase while litigation is pending. Once the lawsuit is resolved, the lis pendens should be removed from the record. Lis pendens notices appear on title searches and must be resolved before closing.
Pro Tip
A lis pendens will prevent your property from selling until resolved.
