About this term

Beneficial interest is important in trusts, land trusts, and partnerships where legal and beneficial ownership are separated. The beneficial owner enjoys the economic returns and use of the property while the legal owner (trustee) holds title. Beneficial interests can be transferred independently of legal title, and beneficial owners have rights to income, appreciation, and eventually the property itself or its proceeds.

Pro Tip

Ensure your beneficial interest is documented in a separate beneficiary agreement to clarify your rights.

Example

In a land trust, the beneficial owner enjoys the home, claims the mortgage interest deduction, and receives sale proceeds, while the trustee simply holds legal title.
